Conditions of Using myELCON
1. Terms and Conditions: The following terms shall govern your use of the software and information (“Materials”) of ELCON or its third-party suppliers and any updates that are made available for downloading via the myELCON, unless otherwise specifically agreed with ELCON.
2. User Account: To enable the User the download of the required Materials, ELCON will set up a password-protected User Account, which will be individually enabled after the User has logged on to the system and accepted these usage conditions. In case of violations of these usage terms, in particular if the User has infringed existent intellectual property rights, ELCON shall be entitled, to restrict or deny access to the User Account. The User is obliged to treat its account data as confidential information and must not disclose them to unauthorized third parties.
3. Software: ELCON grants you a non-exclusive, worldwide, royalty-free right to download and use the Materials made available via myELCON, to the terms and conditions as set forth herein. With respect to Software, the term'Use' means storing, installing, executing or displaying the Software: (i) in object code form, and, is applicable (ii) in conjunction with ELCON equipment. The Software must not be decompiled, modified and you are not allowed to disable control features or remove any licensing marks from the Software.
4. Ownership: The Materials are owned and/or copyrighted by ELCON or its third-party suppliers. When downloading ELCON Materials you understand and agree that this does not mean you acquire any ownership or title to them. Software offered via myELCON, for download may contain Open Source software, which is subject to the common regulations applicable to Open Source software. It is ELCON´s corporate policy to safeguard third-party´s intellectual property rights, and we do expect the same from each User of ELCON Materials.
5. Disclaimer: The Materials of ELCON Systemtechnik GmbH, together with all accompanying documentation, and any updates made available for download through myELCON,are provided 'AS IS', with all defects and without any warranties of any kind, express or implied, including, without limitation, warranties of merchantability or fitness for a particular purpose. ELCON further does not warrant the accuracy or completeness of the information, text, graphics, links or other items contained within these Materials.
6. Limitation of liability: ELCON assumes no responsibility for errors or omissions in the Materials made available for download. ELCON shall not be liable for any special, indirect, incidental, or consequential damages, including without limitation, lost revenues or lost profits, which may result from the download and subsequent use of the ELCON-Materials and/or ELCON-Software, irrespective of whether or not you have been advised of the possibility of such damages. The information provided on this server is subject to change without notice and does not represent a commitment on the part of ELCON.
7. Laws These Conditions of Use shall be governed by the Laws of the Federal Republic of Germany. Legal venue shall be Chemnitz/Germany.
